SOFTWARE LICENSE AGREEMENT
PLEASE REVIEW THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE
DOWNLOADING OR USING THE SOFTWARE. BY INSTALLING, COPYING, OR OTHERWISE USING
THIS PROGRAM, YOU INDICATE YOUR ACCEPTANCE OF SUCH TERMS AND CONDITIONS.
IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE PRODUCT.
Single User License: JCL Consultants Inc. ("JCL Consultants")
and its suppliers if any grant to Customer ("Customer") a
non-exclusive and non-transferable license to use the JCL Consultants
software ("Software") on a single computer.
Customer may make one (1) archival copy of the Software provided Customer
affixes to such copy all copyright, confidentiality, and proprietary
notices that appear on the original.
These Programs contain confidential and/or proprietary information and
constitute themselves a confidential software which must be treated in
confidence by each User.
EXCEPT AS EXPRESSLY AUTHORIZED IN THIS AGREEMENT, CUSTOMER SHALL NOT: COPY,
IN WHOLE OR IN PART, SOFTWARE OR DOCUMENTATION; MODIFY THE SOFTWARE;
REVERSE COMPILE OR REVERSE ASSEMBLE ALL OR ANY PORTION OF THE SOFTWARE;
OR RENT, LEASE, DISTRIBUTE, SELL, OR CREATE DERIVATIVE WORKS OF THE
SOFTWARE.
To use a Product identified as an upgrade, you must first be licensed for
the product identified by JCL Consultants Inc. as eligible for the
upgrade. After upgrading, you may no longer use the product that
formed the basis for your upgrade eligibility. This license agreement
applies to updates or supplements to the original Product provided by
JCL Consultants Inc., unless we provide other terms along with the
update or supplement.
Without prejudice to any other rights, JCL Consultants Inc. may cancel this
license agreement if you do not abide by the terms and conditions of this
license agreement, in which case you must destroy all copies of the Product
and all of its component parts.
You agree that JCL Consultants Inc. and its affiliates may collect and use
technical information you provide as a part of support services related to
the Product. JCL Consultants Inc. agrees not to use this information in a
form that personally identifies you.
The Product is protected by copyright and other intellectual property laws
and treaties. JCL Consultants Inc. own the title, copyright, and other
intellectual property rights in the Product.
RESTRICTED USE DURING EVALUATION PERIOD Customer may use a free trial copy
of the Software for a 30 day period of time ("Evaluation Period") for
evaluation purposes only. If Customer is satisfied that the Software
fulfills its requirements, Customer may purchase and register the
Software and remove this restriction by obtaining a registration key
from JCL Consultants.
IN NO EVENT, IN REGARD TO THE USE, OR THE INABILITY TO USE, THE CONTENT,
MATERIALS AND FUNCTIONS OF THESE PROGRAMS, WILL JCL CONSULTANTS INC. OR ITS
SUPPLIERS BE LIABLE FOR ANY DAMAGES OR INJURY CAUSED BY, INCLUDING BUT NOT
LIMITED TO, ANY FAILURE, BUSINESS INTERRUPTION, PERSONAL INJURY, LOSS OF
PRIVACY, PERFORMANCE, ERROR, OMISSION, DIRECT, INDIRECT, SPECIAL OR OTHER
CONSEQUENTIAL DAMAGES OF ANY KIND.
If any provision of this Agreement is ruled invalid, such invalidity shall
not affect the validity of the remaining portions of this Agreement.
